Description

The Insolvency Compensation Fund compensates for outstanding employee contribution shares to the statutory social insurance in the event of a company insolvency, if these claims cannot otherwise be collected. Beneficiaries include employees, former employees, freelance contractors, home workers, as well as their heirs, whose employment relationship is subject to the General Social Insurance Act (ASVG) and for whom insolvency proceedings have been opened or could not be opened due to insufficient assets to cover costs. The support is provided as an unlimited grant and can be continuously applied for at the federal level in Austria.

A prerequisite for granting is an insolvency or comparable ruling, an ASVG-mandatory employment relationship, as well as proof that due contributions cannot be collected by other means. The application must include the application form, the claim registration with the competent insolvency court, and all standard documents listed in the checklist. Since there is no deadline restriction, submissions are possible at any time. Processing is carried out by IEF-Service GmbH on behalf of the Federal Ministry of Labour, Social Affairs, Health, Care and Consumer Protection (Section IX), which also offers consultations on the further procedure.
